Under the Corporations Act 2001 (Cth), you are generally treated as a wholesale client if any of the following apply:

  • Net assets test — net assets of at least $2,500,000, certified by a qualified accountant (s708(8)(c) / s761G(7)(c)).
  • Income test — gross income of at least $250,000 per year for each of the last two financial years, certified by a qualified accountant.
  • Product value test — the amount payable for the financial product is at least $500,000 (s708(8)(a)).
  • Professional investor — an AFSL holder, an APRA-regulated body, a listed entity, or a person controlling gross assets of at least $10,000,000.
  • Experienced investor — a licensee is satisfied you have previous experience letting you assess the offer, and gives written reasons (s708(10)).
